Terms of Use

1. Licence to use the app

I give you a personal, non-exclusive, non-transferable licence to install and use Updately on Macs you own or control, running macOS 14 Sonoma or later. The app is licensed to you, not sold. I keep all rights not expressly given here.

You may not:

• reverse engineer, decompile or disassemble the app, except where the law expressly allows it;
• redistribute, sell, resell, rent or sublicense the app, a license or a code;
• remove or work around its licensing checks, or spoof a Mac’s identity to get another trial.

2. What the app does to your Mac

Updately checks the apps on your Mac for updates and installs them only when you ask (for one app, or with Update All from the window or the notch panel). Installing an update replaces software on your Mac.

Before installing, Updately verifies each download: checksums when the source publishes one, code signatures, that the developer Team ID matches the installed app, and EdDSA signatures for Sparkle updates. It refuses apps and packages whose developer certificate Apple has revoked. Installer packages (.pkg) must pass Apple’s Gatekeeper assessment, and macOS asks for an administrator password to install them. These checks reduce risk but can’t remove it. The third-party apps and their update servers are outside my control, and I am not responsible for their content or behaviour.

• An update may change how a third-party app works, remove features, or break it.
• You are responsible for backing up your Mac (for example with Time Machine) before updating.
• The uninstall feature can move an app and its data to the Trash, or delete it permanently, as you choose. Permanent deletion can’t be undone.

3. Your account

An account is optional. If you create one, keep your sign-in details safe and give accurate information. I may suspend or close an account that is used to abuse the service, attack it, or break these terms. You can delete your account at any time from Settings › Account in the app. How account data is handled is described in the Privacy Policy.

4. Trial, plans and licenses

Purchases are not open yet. During early access, everything in the app is free and unlocked. These terms apply to the trial now, and to purchases once they open.

The free trial

• Each Mac gets one free trial of 7 days with every feature, starting when you finish setting up Updately on it (onboarding). No payment or account is needed.
• The trial belongs to the Mac, not to an account. It runs once per Mac: reinstalling the app or using another account doesn’t start a new one.

Plans

• A plan is a one-time purchase, not a subscription: $2.99 for up to 2 macs, $4.99 for up to 5 macs, $9.99 for unlimited macs. Every plan includes every feature; plans differ only in how many Macs can use the license at once.
• A purchase is a lifetime license, tied to your Updately account. It is for your own Macs.
• Buying a bigger plan later replaces the smaller one: your account gets the larger number of Macs. The earlier purchase is not refunded or credited.
• Payments are processed by Polar (polar.sh), which acts as Merchant of Record. Polar is the seller of record and handles payment, card details, sales tax or VAT and invoices. Polar’s own terms and privacy policy apply to the checkout. I never receive your card details.
• A license is digital content delivered immediately. All sales are final, as set out in the Refund Policy, subject to any rights you have under the law.

Your Macs

• You add a Mac to your license from the app while signed in, up to your plan’s number of Macs. When the license is full, remove a Mac to add another.
• You can remove any of your Macs from the app, except the one you are using. A removed Mac loses access the next time it checks in, until you add it back or sign in on it and add it.
• The app checks your license with my server when it opens (after onboarding finishes; the first trial check happens only then), when it comes to the front, every 15 minutes while it runs, before Update, Update All, Install or Uninstall, when you sign in, when the plan window opens, and when you press Check Again. It receives a signed license token that lets it keep working offline for up to 72 hours after its last successful check. A Mac that has never reached the server gets 24 hours. After that, it needs to reach the server again.

Codes

• A code (for example from a giveaway) gives the account that redeems it a license for the number of Macs the code states. It never lowers a license you already have.
• Each code works once. Codes have no cash value and may not be sold or traded.
• I may cancel a code that was sold, shared publicly or obtained unfairly, and the license it gave with it.

Transfers and revocation

• A license can’t be transferred, resold or shared with another account.
• If a payment is refunded or reversed (for example through a chargeback), the license it paid for is revoked and the Macs it covered lose access.
• I may revoke a license that is used to break these terms, for example by sharing an account to get around the Mac limit.

5. No warranty

To the extent permitted by law, Updately is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability and non-infringement. I don’t promise the app will be error-free, will find every update, or that any update it installs will work correctly.

6. Limitation of liability

To the extent permitted by law, I am not liable for any indirect, incidental or consequential loss, or for loss of data, software, profits or business, arising from your use of Updately. My total liability for any claim is limited to the amount you paid for your Updately license, or USD 10 if you paid nothing.

Some countries don’t allow these exclusions or limits, so they may not fully apply to you. Nothing in these terms limits liability that can’t be limited by law.

7. Trademarks

Mac, macOS and App Store are trademarks of Apple Inc. Homebrew, GitHub, Sparkle, Google and Firebase are trademarks of their respective owners. Other app names and icons shown in Updately belong to their owners. Updately is an independent product and is not affiliated with, endorsed by, or sponsored by any of them.

8. Changes to these terms

I may update these terms. When I do, I will post the new version on this page and change the date at the top. If you keep using Updately after that, the new terms apply.

9. Governing law

These terms are governed by the laws of Pakistan, and the courts of Karachi have jurisdiction over disputes. This does not take away any mandatory consumer protection you have under the law of the country you live in.
